Supreme Court Ruling on Kpandai Seat Affirms Legal Process – Gary Nimako

The Director of Legal Affairs of the New Patriotic Party (NPP), Mr. Gary Nimako Marfo, has hailed the Supreme Court’s decision to overturn a High Court ruling that annulled the election of the party’s parliamentary candidate for Kpandai, Mr. Matthew Nyindam, describing it as clear, emphatic, and final.

The Supreme Court, in a 4–1 majority verdict, set aside the Tamale High Court judgment that had previously nullified Mr. Nyindam’s election. Justice Gabriel Scott Pwamang, presiding over the five-member panel, issued the sole dissenting opinion.

The ruling followed an application by Mr. Nyindam, who challenged the High Court’s judgment under the Supreme Court’s supervisory jurisdiction, citing a jurisdictional error. The apex court upheld his claim, finding that the High Court had acted without the proper authority to annul the parliamentary election.

As a result, Mr. Nyindam’s election has been reinstated, confirming him as the duly elected Member of Parliament for the Kpandai Constituency.

Reacting to the verdict, Mr. Nimako Marfo emphasized that the Supreme Court had decisively clarified the legal position, leaving no room for doubt.

“The Supreme Court has spoken emphatically that the decision of the Tamale High Court was made without jurisdiction, and it has therefore been quashed,” he said. “Honourable Nyindam remains the MP for the people of Kpandai. That position is maintained.”

Mr. Nimako Marfo also underlined the importance of respecting judicial decisions, noting that adherence to court rulings is fundamental to the rule of law.

“When it comes to court, the decision goes one way or the other. You take the legal route, and the court has said thus. That should be it,” he added.
